T&C's

1. Introduction

These Terms and Conditions govern the provision of website design, digital marketing materials and related services by Swift Sites (“we”, “us”, “our”) to the client (“you”, “your”).

By instructing Swift Sites to commence work, you agree to be bound by these Terms and Conditions.

2. Scope of Services

 

Swift Sites provides services including, but not limited to:

  • Website design and development
     
  • Website redesign and updates
     
  • Digital brochures and marketing materials
     
  • Landing pages
     
  • Content layout and formatting
     
  • Basic SEO setup
     
  • Ongoing website support (if agreed separately)
     

A written proposal, quotation or email confirmation will outline the specific services agreed for each project.

3. Payment Terms

 

3.1 Deposit

A 50% non-refundable deposit is required before any work begins.

No design, development, or content work will commence until the deposit has been received.


3.2 Final Payment

The remaining 50% balance is due upon completion of the agreed work, prior to:

  • Website launch
     
  • Transfer of files
     
  • Handover of login details
     
  • Publication of digital materials
     

Completion is defined as the point at which the agreed scope of work has been delivered and presented to the client for approval.


3.3 Late Payments

Swift Sites reserves the right to:

  • Delay launch or delivery
     
  • Suspend access to the website
     
  • Apply statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998
     

until outstanding invoices are settled in full. 

4. Revisions and Amendments

 Unless otherwise stated in writing, projects include:


  • One initial design concept
     
  • Up to two rounds of reasonable revisions
     

Additional revisions or changes outside the agreed scope will be charged at our standard hourly rate or quoted separately.

5. Client Responsibilities

 The client agrees to:


  • Provide all required content (text, images, logos, branding) in a timely manner
     
  • Ensure all content supplied is legally owned or properly licensed
     
  • Respond to requests for feedback within a reasonable timeframe
     

Delays in receiving content or approvals may affect the project timeline.

6. Intellectual Property

 Upon full and final payment:


  • The client owns the final approved website design and agreed deliverables.
     
  • Swift Sites retains the right to showcase completed work in its portfolio, marketing materials, and website unless agreed otherwise in writing.
     

Any third-party software, themes, hosting platforms or plugins remain subject to their respective licensing terms.

7. Hosting and Third-Party Services

If hosting, domain registration, email marketing platforms or other third-party services are used:

  • These may be billed separately
     
  • The client may be required to hold their own account
     
  • Swift Sites is not responsible for third-party outages, platform changes or pricing increases

8. Liability

Swift Sites will provide services with reasonable care and skill.

However, we are not liable for:


  • Loss of profits
     
  • Loss of business
     
  • Indirect or consequential losses
     
  • Website downtime caused by hosting providers
     
  • Content inaccuracies supplied by the client
     

Total liability shall not exceed the total fees paid for the project.

9. Cancellation

 If a client cancels a project after work has commenced:

  • The 50% deposit is non-refundable
     
  • Any additional work completed beyond the deposit value may be invoiced
     

Swift Sites reserves the right to cancel a project if:


  • Payments are not made
     
  • Communication breaks down
     
  • The client engages in abusive or inappropriate conduct

10. Website Maintenance

 Unless agreed as part of an ongoing support package:


  • Swift Sites is not responsible for updating, maintaining or securing the website after handover.
     
  • Future updates will be quoted separately.

11. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Acceptance

 Payment of the deposit confirms acceptance of these Terms and Conditions.
